Axiata Game Hero - Terms & Conditions
The Axiata Game Hero (“Axiata Game Hero”) is a mobile game portal that offers all genre of mobile game, web game and tournament game available on smartphones. The Axiata Game Hero Tournament is a regional eSports tournament (hereinafter referred to as “Tournament”) in collaboration with Axiata Group Berhad, XL Axiata, , Robi Axiata and Smart Axiata (Mobile Operators”). The Tournament is organized by Axiata Game Hero (“the Organizer”). By participating in the Tournament, the Participants (“Participants”) hereby agree to be bound by these terms and conditions which shall form an integral part of, and to be read together with, the terms and conditions of the Participants’ registration form (“CRF”) and/or terms and conditions of the respective mobile/content service(s) offered and relevant to the Participants in respect of the Tournament.
In the event of a conflict or inconsistency between these terms and conditions and CRF and/or terms and conditions of the respective mobile/content service(s), such inconsistency shall be resolved by giving precedence in the following decreasing order:
- these terms and conditions;
- terms and conditions of CRF; and
- terms and conditions of the respective mobile/content service(s).

The Organizer reserves the right to change the below information at any time without prior notice. - The Organiser’s employees (including employees of its related corporation), their advertising agency and their immediate family members; and
- For clarity, immediate family members shall be:
- For unmarried/single employees – their parents and sibling(s) and spouse(s) of the sibling(s); and
- For married employees – their spouse(s), parents and children (including adopted children).

Upon the completion of registration for the Tournament, Participants consent to allow the Organizer to: - Exclusion of Liability

1.1
The Organizer reserves the sole and absolute right to withdraw, amend, omit and/or vary any part or the whole of the terms and conditions of this Tournament with a prior notice to the Participants herein stated and the Participants shall be bound to observe, perform and comply with the terms and conditions herein and any amendments thereof so notified to the Participants.
1.2
The Organizer’s decisions on any matter relating to the Tournament are final and binding on all Participants. If any matters were to arise which are not covered in these terms and conditions, these matters will be determined solely by the Organizer.
1.3
The Organizer may change any of these terms and conditions including terminating or suspending the Tournament and extending the Tournament Period (as hereinafter defined). Any such change will be announced in the website. It is your responsibility to check these terms and conditions on the website and if you do not agree to any of the changes, you must immediately cease participation in the Tournament.
1.4
Except as expressly mentioned herein, the Organizer shall not be responsible for any expenses and costs incurred by a Participant, including out-of-pocket expenses related to or as a consequence of participating in this Tournament.
2.1
All Participants are expected to play at their best at all times without getting involved in the following offences:

PC/Emulator | Strictly not allowed, if player are found using pc emulators the squad will be disqualified |
2.2
The Organizer shall have the right, at its own discretion to disqualify, exclude or eliminate the Participants from participation in the Tournament, to refuse from awarding the prize and to demand the return of any previously awarded prizes in the Tournament in the event the Participants committed any offences as specified in Clause 2.1 above.
3.1 Participants Eligibility
3.1.1
The Participant must be at least eighteen (18) years of age to join the Tournament.
3.1.2
The Tournament is open to all active Mobile Operators postpaid and prepaid
subscribers who holds an individual account (supplementary line(s) and
corporate account is/are excluded). For the avoidance of doubt, "active" in this
section means a subscriber who is able to make and receive calls.
3.1.3
The Participant must be the sole owner of the SIM card subscription and the mobile number (MSISDN) used in the Tournament. The Participant is not allowed to appoint any other individual to represent him or her in the Tournament.
3.1.4
For clarity, the following personnel shall not be eligible to participate in any Tournament:
3.1.5 Disqualification
The Organizer reserves the right to reject any entries at its discretion subject to Clause 2 and Clause 3.2 of this terms & conditions.
3.2 Tournament registration
Participants are required to go through the processes of registration to Axiata Game Hero and Free Fire account verification (as hereinafter defined) in order to join the Tournament. During the event in which successfully registered Participants unsubscribed to Axiata Game Hero as specified in Clause 3.2.1.3, got suspended in Free Fire as specified in Clause 3.2.2.3 or left their Squad(as hereinafter defined) as specified in Clause 3.2.4, Participants are disqualified until the situation is rectified (as shall be confirmed to be rectified by a written notice by the Organizer) .
3.2.1 Subscription to Axiata Game Hero
3.2.1.1
A Participant needs to subscribe to Axiata
Game Hero (“Subscription”) to join the Tournament. The
Participant’s subscription to Axiata Game Hero will be
subjected to a daily
charge (“Subscription Period”) of
TK 5.00 (VAT+SD+SC) (“Subscription Fee”) for
Robi Axiata and Airtel users. The Subscription
Fee shall be reflected in the Participant’s postpaid bill
or deducted from the Participant’s prepaid account. Upon
successful Subscription, the Participant shall receive an
SMS confirmation of the Participants’ subscription from
Mobile Operators.
3.2.1.2
Mobile Operators shall send a reminder to the Participant
prior to the expiry of each Subscription. Upon expiry of
the Subscription Period, the Subscription shall be
automatically renewed unless the Participant opts out in
the manner as specified in Clause 3.2.1.3 of this terms
and conditions.
3.2.1.3
If a Participant terminates its Subscription to Axiata Game Hero via SMS or clicking the unsubscribe button in the profile page of www.gamehero.asia/bd website or contact the Organiser to cancel his or her Subscription to Axiata Game Hero, the Participant will be removed from the leaderboard on www.gamehero.asia/bd/leaderboard (“Leaderboard”).
3.2.1.4
The Participant may at any time thereafter re-subscribe to Axiata Game Hero and join the Tournament, however, the previous ranking will no longer be available and will not be taken into consideration for the Tournament.
3.2.1.5
Subject to Clause 3.2.1.4 above, if the Subscription of a Participant becomes inactive due to unsuccessful renewal, the Participant will have a grace period of 24 hours from the date the Subscription becomes inactive to renew the Subscription. If the Participant fails to renew the Subscription within the aforesaid grace period, his or her Subscription will become inactive and the previous ranking will no longer be available and will not be taken into consideration for the Tournament.
3.2.2 Free Fire player account
3.2.3 Solo Tournament
3.2.3.1
The Participant joins the Tournament as a Solo player until 30th September 2019 (“Solo Tournament”).
3.2.3.2
The results of those Solo players with the highest score earned during the Solo Tournament will be uploaded to the Solo Leaderboard until 30th September 2019.
3.2.3.3
In the event there are two (2) or more Solo players who achieved the same score by the end of the Solo Tournament (a tie score), the Solo player who attained the first tied score will be ahead of the other Solo player who attained the same score at a later time.
3.2.3.4
The top forty eight (48) Solo players on the Solo Leaderboard by end of the Solo Tournament, will proceed to form twelve (12) Squads as specified in Clause 3.2.4.
3.2.4 Squad
3.2.4.1
A Participant must join a squad of four (4) in order to join the National and Grand Championship (“Squad”).
3.2.4.2
Each Participant can be a member of only one (1) Squad throughout the Tournament.
3.2.4.3
The member who has the highest score among the other members in the same Squad, is automatically the Squad leader.
3.2.4.4
A Squad may not change its squad name throughout the Tournament Period as specified in Clause 3.3.
3.2.4.5
If the Squad leader left the Squad, the second person who has the highest score automatically becomes the Squad leader.
3.3 Tournament mechanism
3.3.1 Tournament stages
There are three (3) Tournament stages throughout a period of seven (7) months which shall be commencing from 31st May 2019 to 31st December 2019 (“Tournament Period”).

3.3.3 Prizes
4.1
Collect, record, hold, store, use and disclose their personal information for purposes which are necessary or related to participation in the Tournament.
4.2
Disclose or publish their personal information such as their names and identities and any general information that the Organizer sees fit about the Participants in any media, marketing or advertising materials.
4.3
Grant the Organizer the absolute and unrestricted right to modify, use and publish any still or moving images of the Participants for any promotional, marketing, commercial or other related purpose, without any payment or compensation.
5.1
To the extent permitted by law, the Organizer excludes all liability in connection with the Tournament. All Participants agree to release the Organizer from and indemnify the Organizer against all liability (including negligence) for any personal injury or for any loss or damage (including loss of opportunity), whether direct or indirect, special or consequential arising out of participation in the Tournament.
5.2
The content provided on the website and any other information provided in relation to the game and Tournament is strictly on an “as is, where is” basis. The Organiser does not guarantee nor warrant true and flawless representation of the game and the Tournament.
5.3
The Organizer disclaims any responsibility and liability from any loss and disruption caused by the malfunction of the mobile phone, viruses or contamination which is beyond the control of the Organizer.
5.4
Once the game has commenced, any Participants’ inability to play due to faulty hardware or any malfunction on the mobile phone or any other technical failures which is beyond the control of the Organizer shall not entitle the Participants to any refund of the subscription charges.
6.1
The information contained herein on websites and Tournament which include but not limited to texts, graphics, photos, sounds, video, software, interactive feature and trademark, service marks and logos shall be solely owned by the Organizer and the Participants undertake not to misuse any of the information contained herein.
6.2
The Organizer reserves the right to terminate and revoke the Participants’ subscription and participation in the Tournament if the Participants violate the provision in relation to intellectual property rights contained herein.
The Tournament(s) and these terms and conditions are governed by the laws of Bangladesh. The Participants agree that the Courts of Bangladesh shall have non-exclusive jurisdiction over all matters arising from the Tournament.
Neither party shall be responsible for its failure to perform due to causes beyond its reasonable control such as acts of God, fire, theft, war, riot, embargoes or acts of civil or military authorities.
Failure by either party to enforce any provision of these terms and conditions will not be deemed a waiver of future enforcement of that or any other provision.
If for any reason a court of competent jurisdiction finds any provision of these terms and conditions, or portion thereof, to be unenforceable, that provision of the terms and conditions will be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remainder of this terms and conditions will continue in full force and effect.
